Removal of Photo Credit Qualifies as DMCA Violation

A lower court decision to dismiss a copyright lawsuit against a radio station’s use of a photo without due credit has been overturned by a Federal Appeals Court. The station argued successfully to the lower court that the image was not covered by Digital Millennium Copyright Act. The Appeals Court said that the original court ruling was "simply wrong".

On appeal, however, Murphy's lawyers argued that removal of the gutter credit was a violation of the DMCA, because gutter credits fall under the DMCA definition of copyright management information.
